Terms of Service

These Terms of Service ("Terms") govern your use of the DevOpser Lite platform and related services ("Service") operated by DevOpser LLC ("DevOpser", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Description of Service
DevOpser Lite provides:
- An AI-powered website builder with drag-and-drop editing
- Managed website hosting and deployment
- Domain name registration and DNS management
- Lead capture forms, inbox, and analytics
- Branded email sending from custom domains
- Automation workflows for leads, including integrations with third-party services (webhooks, Slack, and other connectors)
- Team collaboration features
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will endeavor to provide at least 30 days' notice for material changes that affect your existing use.
2. Eligibility
You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. Account Registration and Security
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately at info@devopser.io of any unauthorized use of your account
- We strongly recommend enabling two-factor authentication (MFA), especially if you manage domain registrations
4. Free Plan
New accounts receive a free plan with one website. The free plan allows you to build and publish one website indefinitely. Premium features such as custom domains and branded email require a paid subscription. We reserve the right to modify the free plan at any time.
5. Subscriptions and Payment
5.1 Subscription Plans
The Service is offered under tiered subscription plans (Starter, Pro, Business, Agency) as described on our Pricing page. Features and limits vary by plan.
5.2 Billing
- Subscriptions are billed in advance on a monthly recurring basis
- Payment is processed by Stripe, Inc. By subscribing, you also agree to Stripe's terms of service
- Subscriptions automatically renew unless cancelled before the end of the current billing period
- If you subscribe through the Apple App Store or Google Play, billing is governed by those platforms' respective terms
5.3 Plan Changes
- Upgrades take effect immediately. You will be charged the prorated difference for the remainder of the billing period
- Downgrades take effect at the end of the current billing period
5.4 Refunds
Subscription fees are generally non-refundable. However, if you are entitled to a refund under applicable consumer protection laws in your jurisdiction, we will comply with those requirements. Contact info@devopser.io for refund requests.
5.5 Price Changes
We reserve the right to change subscription pricing with at least 30 days' advance notice. Price changes will apply to the next billing cycle after the notice period.
5.6 Domain Policies with Subscriptions
- Paid subscription plans include one domain registration per site slot at no additional cost, provided the domain's annual registration cost (at the registrar) does not exceed one month of the subscription price per site. For example, a Starter plan ($29/month, 1 site) includes domains costing up to $29/year at the registrar (most standard .com, .net, and .org domains qualify)
- Premium and specialty domain extensions (e.g., .io, .ai, .dev) may have registration costs that exceed the included domain budget. In such cases, the domain may be purchased separately at the displayed price, which includes a service markup
- Included domains are provided as part of the subscription benefit. Upon cancellation or downgrade to a free plan, all included domains will have automatic renewal disabled. The domain remains registered and functional until its expiration date (typically one year from registration), but will not be renewed at our expense
- Promotional offers and discount codes (e.g., a free first month) do not include the free domain benefit. The included domain benefit begins with the first billing cycle in which actual payment is collected
- Complimentary subscriptions and referral reward site slots do not include free domain registrations. Users on these plans may purchase domains at the standard price or connect a domain they already own
- Paid plan subscribers may connect a domain they already own ("Bring Your Own Domain") to their sites at no extra charge. DNS and SSL are configured automatically
6. Domain Registration
6.1 Domain Purchases
You may purchase domain names through the Service. Domain registration is processed through AWS Route53 and is subject to AWS's domain registration agreement and ICANN policies.
6.2 WHOIS Information
Domain registration requires accurate contact information as mandated by ICANN. Providing false WHOIS information may result in domain suspension. We provide WHOIS privacy protection where available.
6.3 Domain Renewal
Domains auto-renew annually unless you disable auto-renewal before the expiration date. You are responsible for ensuring timely renewal. We are not liable for domains that expire due to disabled auto-renewal or failed payment.
6.4 Domain Transfers
You may transfer your domain to another registrar at any time, subject to the following:
- ICANN 60-day lock: Per ICANN policy, newly registered domains cannot be transferred to another registrar within 60 days of initial registration
- Transfer process: To initiate a transfer, contact info@devopser.io. We will unlock the domain and provide the authorization (EPP) code required by the receiving registrar. Transfers are subject to ICANN transfer policies and identity verification
- Your right to transfer: As the domain registrant, you have the right to transfer your domain to any ICANN-accredited registrar after the 60-day lock period. We will not unreasonably delay or refuse a legitimate transfer request
- DNS impact: Transferring your domain away from our platform will disconnect it from your DevOpser site. You will need to configure DNS at your new registrar to point to your site, or use a different hosting provider
6.5 Domain Fees
Domain registration fees are separate from subscription fees and are billed annually. Domain fees are non-refundable once registration is completed.
6.6 Included Domain Recovery Fee
If you received a domain at no cost as part of your subscription ("included domain") and cancel your subscription before the end of the domain's initial registration period (typically one year), we reserve the right to charge a domain recovery fee equal to the actual registration cost incurred by us (the registrar cost, without markup). This fee covers the cost we absorbed on your behalf. We will notify you of the applicable amount before processing the charge. If recovery is not possible (e.g., no payment method on file), automatic renewal will remain disabled and the domain will expire at the end of its registration period.
7. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Publish, host, or distribute sexually explicit, pornographic, or obscene material of any kind
- Publish, host, or distribute content that exploits, abuses, or endangers minors, including but not limited to child sexual abuse material (CSAM). Any such content will be immediately removed and reported to the relevant authorities, including the National Center for Missing and Exploited Children (NCMEC) and law enforcement
- Host or distribute malware, phishing pages, or harmful content
- Send spam, unsolicited bulk communications, or deceptive messages
- Host content that promotes violence, hatred, discrimination, or illegal activities
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with the operation of the Service or other users' use of it
- Use the Service to collect personal data in violation of applicable privacy laws
- Resell or redistribute the Service without our written consent
We reserve the right to remove any content and to suspend or terminate accounts that violate this acceptable use policy, without refund, without liability, and with or without notice depending on the severity of the violation.
8. Your Obligations as a Website Owner
When you publish websites using DevOpser Lite that collect visitor information:
- You are the data controller for visitor data collected through your site's forms
- You must display an appropriate privacy policy on your website
- You must comply with all applicable data protection laws (including GDPR, CCPA, Israeli PPLA, and other relevant regulations) in relation to your visitors' data
- You must obtain any required consent before collecting visitor data
- You are responsible for responding to data subject access requests from your site visitors
- You must not use lead capture forms to collect data from minors without appropriate parental/guardian consent
- If you use automation features to share lead data with third-party services (via webhooks, Slack, or other integrations), you are solely responsible for ensuring those transfers comply with applicable data protection laws and for vetting the third-party recipients of that data. DevOpser acts as a data processor facilitating these transfers at your direction
9. AI-Generated Content
- The Service uses AI to generate website content, images, and code based on your instructions
- AI-generated output may not always be accurate, complete, or suitable for your purposes. You are responsible for reviewing and editing all AI-generated content before publishing
- We do not guarantee that AI-generated content is free from errors, biases, or intellectual property issues
- You are solely responsible for the content published on your website, whether AI-generated or manually created
10. Intellectual Property
10.1 Your Content
You retain full ownership of the original content you create or upload to the Service, including text, images, logos, and designs. You grant us a non-exclusive, worldwide license to host, display, transmit, and distribute your content solely as necessary to provide the Service.
10.2 Our Service
The Service, including its software, design, logos, and documentation, is owned by DevOpser LLC and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding.
10.3 AI-Generated Content
To the extent permitted by applicable law, you own the rights to AI-generated content created through the Service at your direction. We make no representations regarding the copyrightability of AI-generated output under the laws of your jurisdiction.
11. Copyright Complaints (DMCA)
If you believe content hosted on our platform infringes your copyright, please send a notice to info@devopser.io that includes:
- Identification of the copyrighted work
- Identification of the infringing material and its location on our platform
- Your contact information
- A statement that you have a good faith belief the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
- Your physical or electronic signature
Upon receiving a valid notice, we will promptly remove or disable access to the infringing material and notify the site owner.
12. Service Availability
We strive to maintain high availability for hosted websites. While we target 99.99% uptime, the Service is provided on a commercially reasonable efforts basis. We are not liable for downtime caused by:
- Scheduled maintenance (we will provide advance notice where possible)
- Circumstances beyond our reasonable control (see Section 17)
- Issues with third-party infrastructure providers
- Actions or omissions by you or your end users
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities
- Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim
Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
14. Indemnification
You agree to indemnify and hold harmless DevOpser, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Content you publish on websites built with the Service
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Data you collect through your websites' lead capture forms
- Your use of automation features to share lead data with third-party services
15. Termination
15.1 Termination by You
You may cancel your subscription or delete your account at any time from the Account Settings page. Cancellation takes effect at the end of your current billing period. Account deletion is processed immediately (see our Privacy Policy for details on data removal).
15.2 Termination by Us
We may suspend or terminate your account:
- For cause -immediately, if you violate these Terms, the acceptable use policy, or applicable laws
- For convenience -with 30 days' notice if we discontinue the Service
15.3 Effect of Termination
Upon termination:
- Your right to use the Service ceases immediately
- Published websites will be taken offline
- You are responsible for exporting any content you wish to retain before termination
- Domain registrations you have purchased remain yours and can be transferred to another registrar
- We will retain data as described in our Privacy Policy
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Israel, without regard to its conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved as follows:
- Informal resolution -before filing any claim, you agree to attempt to resolve the dispute by contacting us at info@devopser.io. We will attempt to resolve the dispute within 30 days
- Jurisdiction -if informal resolution fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Tel Aviv-Jaffa, Israel
If you are a consumer in the European Union, you retain any mandatory protections provided by the laws of your country of residence.
17. Force Majeure
We are not liable for any failure or delay in performing our obligations under these Terms caused by events beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, power outages, internet disruptions, or failures of third-party service providers.
18. General Provisions
- Entire agreement -these Terms, together with our Privacy Policy, constitute the entire agreement between you and DevOpser regarding the Service
- Severability -if any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force
- Waiver -our failure to enforce any provision does not constitute a waiver of that provision
- Assignment -you may not assign these Terms without our consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets
- No third-party beneficiaries -these Terms do not create any rights for third parties
19. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will provide at least 30 days' advance notice via email. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
